§ 1 Scope
(1) These General Terms and Conditions (hereinafter "GTC") apply to all consulting services provided by Rendercandy Consulting (hereinafter "Provider") to its customers (hereinafter "Customer").
(2) Deviating conditions of the Customer shall not be recognized unless the Provider expressly agrees to their validity in writing.
§ 2 Subject Matter of the Contract
(1) The Provider provides IT consulting services in the form of video call sessions (60 minutes) or in-person meetings (90-120 minutes).
(2) The specific services are defined in the service description on the website. The scope of consultation is limited to the time agreed in the booked package.
§ 3 Conclusion of Contract
(1) The presentation of services on the website does not constitute a binding offer but an invitation to submit an offer (invitatio ad offerendum).
(2) The contract is concluded when the Customer completes the booking process and payment has been made. The Provider confirms the conclusion of the contract by email.
§ 4 Prices and Payment Terms
(1) All prices are stated in Euros and are understood to be net prices.
(2) The Provider is exempt from value-added tax according to §19 para. 1 of the German VAT Act and therefore does not show VAT on its invoices.
(3) Payment is made in advance by credit card, PayPal, or other offered payment methods. The service will only be provided after full payment has been received.
§ 5 Appointment and Performance
(1) The booked appointment takes place at the agreed time. For video calls, the Customer receives an access link by email.
(2) The Customer is obliged to provide all necessary information and documents for the consultation.
(3) The Provider reserves the right to postpone the appointment in case of technical problems.
§ 6 Cancellation and Rescheduling
(1) Appointments can be cancelled or rescheduled free of charge up to 24 hours before the booked time.
(2) In case of later cancellation or no-show by the Customer, the full amount becomes due.
(3) The Provider may postpone appointments for important reasons (e.g., illness). In this case, an alternative date will be offered.
§ 7 Right of Withdrawal for Consumers
(1) Consumers within the meaning of § 13 BGB have a right of withdrawal according to the separate cancellation policy.
(2) For services that are agreed for a specific time (such as consultation appointments), the right of withdrawal expires as soon as the Provider has begun providing the service with the consumer's consent before the withdrawal period has expired.
§ 8 Liability
(1) The Provider is fully liable for intent and gross negligence.
(2) In case of slight negligence, the Provider is only liable for the breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable, contract-typical damage at the time of conclusion of the contract.
(3) Liability for indirect damages, consequential damages, and lost profits is excluded.
(4) The aforementioned limitations of liability do not apply in case of injury to life, body, or health.
§ 9 Data Protection
(1) The collection and processing of personal data is carried out in accordance with the privacy policy.
(2) The Customer agrees that their data will be stored and processed electronically for contract processing.
§ 10 Final Provisions
(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction for all disputes arising from this contractual relationship is the registered office of the Provider, provided that the Customer is a merchant, a legal entity under public law, or a special fund under public law.
(3) If one or more provisions of these GTC are or become invalid, the validity of the remaining provisions shall remain unaffected. An effective provision that comes closest to the economic purpose of the invalid provision shall take the place of the invalid provision.
